Evidence: what actually proves the point?

Separate allegation, inference and admissible or useful evidence.

Learn

A persuasive case is organised around propositions that must be proved. For each proposition, identify the source: document, witness, photograph, recording, metadata, expert evidence, admission or other material. Evidence legislation and admissibility rules differ between Australian jurisdictions and can be technical and fact-dependent, so Legal Lee should load the current evidence rules for the learner’s matter.

See it

“They knew” is an allegation. An email acknowledging receipt may be evidence from which knowledge can be argued.

Try it

Make a claim-evidence table with columns: proposition, evidence, source, date, authenticity issue, contradiction, gap.

Complete the mission

Build an evidence matrix for one dispute and mark every unsupported proposition.
